电子邮件作为互联网的基本要素，是互联网应用最广、体系最开放的服务之一，经过多年的发展，互联网上的大中小型邮件系统都已经十分稳定。但是邮件协议传统上只是单纯的数据编码和交换协议，目前多数的邮件应用不管是电脑端还是移动端也都是以传统的邮件/文本信息交换为主。在传统互联网时期，面对同样的大（电脑）屏幕，普通IM模式和邮件模式在用户体验方面基本类似，只是应用范围不同。在移动互联网时代，IM工具的发行商普遍针对智能手机的特性作了很多改进和提升，比如针对智能手机的麦克风和摄像头功能，推出了语音、照片和视频等等多媒体功能；针对手机屏幕相对较小的情况，改进会话展示从而让用户之间能更好的对话；针对移动网络的多变性和智能手机的电源特性，改进新消息的通知机制等等。但是这些IM工具通常被掌控在行业寡头手中，不仅产生了隐私和权利方面的问题，还造就了许多信息的孤岛，同时也给人们之间的交流增加了不少限制。基于电子邮件的应用性、开放性和稳定性，通过在应用层面针对移动互联网进行相应的改造和提升，比如增加对会话、多媒体内容的支持，以及改进对新邮件的通知推送，我们可以把互联网上分散存在的大中小型邮件系统融合成一个超大型的分布式IM和社交网络。通过这样一个网络，信息能更好的在不同用户之间传递，并且在通过技术手段保留必要的封闭性的同时，提供了极大的开放性。

1. 介绍


      常见的邮件接收协议有IMAP[3]、Exchange[4]和POP3[5]，邮件发送协议则是SMTP[6]和Exchange。POP3是比较早期的邮件协议，因其功能设计上的一些限制，目前的实际应用已经不广。目前主流的邮件系统都是支持IMAP/SMTP和/或Exchange的邮件服务器。为了构建一个尽可能大的分布式网络，需要同时兼容至少IMAP/SMTP和Exchange等邮件协议[7]。
      

2. 多协议支持

邮件协议是一套纯粹的数据编码和交换协议，但它提供了足够好的数据信息以及一定的协议扩展性来提供或者传递实现会话和多媒体功能所需要的信息。比如，邮件协议里的Mime-Type（或者Content-Type）属性可以提供附件的类型信息，邮件内容的Headers或者Properties则可以提供诸如发信人、收信人等等信息。前者对于识别多媒体附件很有帮助，而后者则有助于建立会话式邮件（无需下载整封邮件即可判断会话方）。 
 为了更好的在会话里展示多媒体信息，还需要一些扩展字段来标志邮件的属性，比如对于一封只有语音内容的邮件，就不需要在会话页显示空白的邮件内容，而应该直接显示语音信息。 
 通常有两种方式可以添加这些扩展字段： 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;a.&nbsp;&nbsp;通过在邮件协议的Header里添加扩展字段（X-***）； 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;b.&nbsp;&nbsp;通过在邮件内容里按照预置的规则添加相关信息； 
 这两种方式各有优缺点。前者是比较通用的协议扩展方式，比较适合定义整封邮件的属性，不过当这些扩展字段在不同邮件服务器之间传递时，不排除会出现丢失的情况，并且客户端在获取信息的时候需要获取额外的字段信息，会在某种程度上增加实现复杂度。后者属于邮件内容的一部分，能够更好的定义某一部分邮件内容的属性，不过由于属于邮件内容的一部分，为了不影响邮件内容的显示，通常需要定义在一些不作UI展示的字段中，比如HTML内容的CODE块等等，存在一定的局限性。

3. 协议扩展

传统的邮件软件通常采用基于时间排序的列表形式来管理邮件，不太能有效的追踪邮件的上下文或者需要通过冗长的嵌套引用来提供上下文。通过对邮件数据的整理以建立特定的会话机制，可以更有效的帮助用户维护会话。 
 通常有两种方式来建立会话： 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;a.&nbsp;&nbsp;按照邮件主题来整理会话：同一主题的邮件被归入同一个会话； 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;b.&nbsp;&nbsp;按照发件人/收件人来整理会话：相同发件人/收件人的邮件被归入同一个会话； 
 当采用“按照邮件主题”来整理会话时，由于邮件主题的多变性以及”RE”、”回复”等等前缀的加入，很难有效的追踪会话，所以通常会采用诸如Message-ID和References等等邮件技术字段来追踪会话，但是这样还是会导致会话的错乱，因为转发的邮件也会被包含进会话，从而导致上下文混乱。因此，建议采用”按照发件人/收件人”来整理会话，这样整理出来的会话更具有上下文关联性，也更接近用户已经习惯的IM会话机制。按照这个规则，一对一的邮件就是IM意义上的私聊，而一对多的邮件则是IM意义上的群聊。 
 此外，目前的邮件内容多是以HTML格式编码的，为了能把邮件内容更好的在会话页显示，需要通过技术手段从HTML内容里解析出可读性较强的文本内容。相应的HTML解析技术已经很成熟，这里不作探讨。

4. 会话机制

在IM软件里，通常人们需要手动添加并且（很可能）需要对方认证通过后，才会相互成为对方的联系人，进行交流。而邮件系统则是一个相对开放的体系，即使在传统的邮件使用方式里，只要知道对方的邮箱地址，就可以给其发邮件。但这也带来了一个很大的隐私问题也就是垃圾邮件的问题。为了解决这个问题，建议引入联系人机制： 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;a.&nbsp;&nbsp;用户可以手动（通过邮箱地址）添加对方为联系人: 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;b.&nbsp;&nbsp;当收到一封邮件并且回复过该邮件后，该发件人自动成为联系人； 
 如果对方的客户端也采用了类似的机制，那么在经过初始的”握手式”会话后，双方就自动成为了对方的联系人。 
 当采用”按照发件人/收件人”来整理会话并且引入联系人机制后，对垃圾邮件的过滤也变得相对简单。只有联系人或者预定义的知名发件人的邮件才会出现在默认会话列表里，所有其他发件人的邮件尤其是垃圾邮件和推广邮件都会被默认归类到”陌生人消息”里，不在默认会话列表显示。用户可以通过添加发件人为联系人或者删除某个联系人来将他/她的邮件移入或者移出默认会话列表。

5. 联系人

IM软件之所以被人们逐步采用就在于IM软件发行商通常内置了一套新消息的推送机制，能让用户相对实时的阅读新消息。邮件作为一个通用协议，只定义了相关的标准，具体的实现则需要邮件服务商和相应的客户端相互配合实现。 
 邮件接收协议定义了如下机制来接收新邮件通知： 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;a.&nbsp;&nbsp;IMAP协议定义了IDLE命令，可以用于接收邮件系统的新邮件通知； 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;b.&nbsp;&nbsp;Exchange协议也有相应的回调机制用于接收邮件系统的新邮件通知； 
 由于移动设备的网络多变性以及电源管理特性，不太可能在移动设备上设置相应的回调服务来接收新邮件通知，同时，不同邮件服务商对协议的支持程度也不尽相同，所以就需要客户端的实现方做一些附加的工作来帮助获取和传递新邮件通知。

6. 新消息推送

安全性包括数据传输的安全性和数据存储的安全性。在当前网络攻击层出不穷的情况下，对安全性的重视显得尤为重要。 
 数据传输的安全性包括以下方面： 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;a.&nbsp;&nbsp;客户端与邮件服务商之间的传输安全性：目前的大型邮件服务商通常都支持通过SSL连接来保护传输的数据，客户端应该优先通过SSL与邮件服务器建立连接。同时用户本身也应该优先选用支持SSL的邮件服务商； 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;b.&nbsp;&nbsp;邮件服务商之间的传输安全性：大型邮件服务商之间的数据传递通常也会采用数据保护措施。用户本身应该优先选用安全的邮件服务商； 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;c.&nbsp;&nbsp;客户端的实现方为改善用户体验而实现的功能的传输安全性：前面提到，客户端的实现方为了改善用户体验而有必要为用户实现一些回调机制以接收新邮件通知。在这些实现中，很可能存在传递少量邮件字段或者其它可能的敏感数据的需要，在所有这些流程中，实现方有必要采用包括高强度加密在内的尽可能安全的措施来保护所传递的数据，同时还有必要采用尽可能安全的机制来保护相应的加密密钥不外泄[8]； 
 数据存储的安全性包括以下方面： 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;a.&nbsp;&nbsp;客户端存储的安全性：客户端存储的数据位于用户的移动设备里，通常来说已经受到了设备安全机制的保护，但是对于一些极为敏感的字段比如用户的邮箱密码，还是有必要采用一定的加密措施来做进一步的保护。而用户本身则有义务选用安全的移动设备，并且配置好相应的安全措施比如开机指纹、开机密码等等； 
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;b.&nbsp;&nbsp;客户端的实现方为改善用户体验而实现的功能（如果有）的存储数据的安全性：客户端的实现方在实现新邮件通知功能的时候有可能需要临时存储少量通知信息，同之前提到的一样，实现方有必要采用包括高强度加密在内的尽可能安全的措施来保护所存储的数据，同时还有必要采用尽可能安全的机制来保护相应的加密密钥不外泄[8]；

7. 安全性

用户的隐私是非常重要的，这应该是所有邮件服务商和客户端实现方都应该重视的一个方面。对于用户的各项敏感信息，各方都有必要采用尽可能安全的机制和措施来保护。同时，用户本身也有义务选择安全的邮件服务商和客户端，并做好软硬件配置。 
 隐私还有一项重要的内容是保护用户免受垃圾邮件的骚扰，这一点在前面”联系人”部分已经作了介绍。 
 在本文所介绍的方案里，用户能够自由选择自己认可的邮件服务商，同时所有往来邮件数据都存储在用户自己的邮箱里，避免了数据被行业寡头挟持的情况，这样用户的隐私和权利也得到了更好的尊重和保护。

CHANGES


      As MailBus and user experiences are constantly evolving, we may from time to time:add, change or remove features or services from MailBus (including in relation to whether a feature or service is free of charge or not); and/or suspend, discontinue or terminate MailBus altogether. You agree that we may take any such actions at any time. Where we consider that any changes to MailBus or any services or features accessible within MailBus are reasonably material, we will (where reasonably practicable) notify you (via https://www.chirpeur.com, direct communication to you, on this page or the relevant page for the relevant additional terms or policy, or other means), prior to such changes becoming effective.
      

CHANGES TO MailBus

You need to create an account with us in order to access and use MailBus. Any account that you open with us is personal to you and you are prohibited from gifting, lending, transferring or otherwise permitting any other person to access or use your account. Your account name, user ID and other identifiers you adopt within MailBus remains our property and we can disable, reclaim and reuse these once your account is terminated or deactivated for whatever reason by either you or us. 
 You are responsible for: (a) safeguarding your account details, including any passwords used to access your account and MailBus, and (b) all use of MailBus under your account, including any purchases made and/or payment obligations arising under your account. You must promptly notify us by going to "Me" -> "Settings" -> "Help & Feedback" from within the MailBus app or by visiting https://www.chirpeur.com if you know or suspect that your password or account has been compromised. We will regard all use of your account on MailBus as being by you, except where we have received a valid and properly received notification to us regarding your account or password being compromised. 
 We may allow you to register for and login to MailBus using sign-on functionalities provided by third party platforms, such as Facebook or Google. You agree to comply with the relevant third party platform's terms and conditions applicable to your use of such functionalities (in addition to these Terms).

YOUR ACCOUNT

When you submit, upload, transmit or display any data, information, media or other content in connection with your use of MailBus (“Your Content”), you understand and agree that:you will continue to own and be responsible for Your Content;we will not sell Your Content to any third party;you are giving us and our affiliate companies a perpetual, non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use Your Content (with no fees or charges payable by us to you) for the purposes of providing, promoting, developing and trying to improve MailBus and our other services, including new services that we may provide in the future. All such use will, to the extent Your Content contains Personal Information, be in accordance with our MailBus Privacy Policy.  We reserve the right to block or remove Your Content for any reason, including as is in our opinion appropriate, as required by applicable laws and regulations. We reserve the right to artificially manipulate the visibility, status, or rank of Your Content on MailBus.

YOUR CONTENT


        You are solely responsible for Your Content. We are not responsible for maintaining a backup of Your Content - we recommend that you keep a back-up copy of it at all times.You must at all times ensure that: (a) you have the rights required to copy, process, transmit, access, publish, display and use Your Content, and to grant us and other third parties the rights as set out in these Terms; and (b) Your Content (and our use of Your Content in accordance with these Terms) does not infringe or violate any applicable laws or regulations or the rights of any person.
        

Responsibility for Your Content


        Content may not be submitted to MailBus, who will moderate all content and ultimately decide whether or not to perform a submission to the extent such content includes, is in conjunction with, or alongside any, Objectionable Content. Objectionable Content includes, but is not limited to: (i) sexually explicit materials; (ii) obscene, defamatory, dbelous, slanderous, violent and/or unlawful content or profanity; (iii) content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right, or that is deceptive or fraudulent; (iv) content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition and/or firearms; and (v) gambling, including without limitation, any online casino, sports books, bingo or poker.
        

Objectionable Content Policy

We are not responsible for and we do not endorse, support or guarantee the lawfulness, accuracy or reliability of any content submitted to, transmitted or displayed by or linked by MailBus, including content provided by users of MailBus or by our advertisers. You acknowledge and agree that by using MailBus, you may be exposed to content which is inaccurate, misleading, defamatory, offensive or unlawful. Any reliance on or use of any content on or accessible from MailBus by you is at your own risk. Your use of MailBus does not give you any rights in or to any content you may access or obtain in connection with your use of MailBus. 
 We also do not guarantee the quality, reliability or suitability of any third party services, programs or websites provided, made available, advertised or linked through MailBus (including any of MailBus's associated platforms or services) and we will bear no responsibility for your use of or relationship with any such third parties services, programs or websites, including any payment obligations or fees that you may incur in your use of such third party services or websites.We may review (but make no commitment to review) content (including any content posted by MailBus users) or third party programs or services made available through MailBus to determine whether or not they comply with our policies, applicable laws and regulations or are otherwise objectionable. THIRD PARTY CONTENT AND SERVICES


        MailBus may include advertising or commercial content. You agree that we may integrate, display and otherwise communicate advertising or commercial content in MailBus and that (where reasonably practicable) we will identify such advertising or commercial content.
        

ADVERTISING CONTENT ON MailBus

All intellectual property rights in or to MailBus and any MailBus Software (including any future updates, upgrades and new versions to all such MailBus Software), will continue to belong to us and our licensors. Except as expressly provided in these Terms, you have no right to use our intellectual property rights, including our trademarks or product names (for example, “LinkSure” or “MailBus”), logos, domain names or other distinctive brand features, without our prior written consent. Any comments or suggestions you may provide regarding MailBus are entirely voluntary and we will be free to use these comments and suggestions at our discretion (including using such comments to improve existing services or create new services) without any payment or other obligation to you. 
 We grant you a limited, personal, on-exclusive, non-sublicensable, non-transferrable, royalty-free and revocable right to use MailBus and any software from us as part of or in relation to your use of MailBus (any such software being the "MailBus Software"), solely in accordance with these Terms and subject to any other instructions as provided by us to you in relation to your use of MailBus and/or the MailBus Software from time to time. Please note that these terms may be supplemented by terms and conditions applicable to MailBus Software (or specific features within MailBus Software). 
 You may not copy, modify, create derivative works, reverse compile, reverse engineer or extract source codes from MailBus Software, and you may not sell, distribute, redistribute or sublicense MailBus or the MailBus Software, except in each case to the extent that we may not prohibit you from doing so under applicable laws or regulations or you have our prior written consent to do so. Where applicable laws or regulations entitle you to reverse compile or extract source codes from MailBus Software, you will first contact us to request the information you need. 
 We may from time to time provide updates to MailBus Software. Such updates may occur automatically or manually. Please note that MailBus Software may not operate properly or at all if upgrades or new versions are not installed by you. We do not guarantee that we will provide any updates for any MailBus Software, or that such updates will continue to support your device or system. All updates to the MailBus Software are part of the MailBus Software and subject to these Terms, except as otherwise specified by us. 
 For the purposes of these Terms, “MailBus Software” includes any items, content or features (the "Items") within the MailBus Software – for example any content accessed or used by you within MailBus. You must comply with any Additional Terms applicable to any such Items. We will notify you of any such additional terms and conditions within MailBus, within an Appendix to these Terms and/or in another manner. We may grant you a limited right to use these Items upon payment by you of "real world money" as applicable from time to time. You acknowledge that you do not own these Items and the amounts associated with such Items do not refer to any credit balance of real currency or the equivalent. We may eliminate these Items from MailBus at any time, and we have no liability to you in the event that we exercise these rights. 
 We may in our discretion provide technical support for MailBus (whether for free or for a fee). We provide technical support without any guarantee or warranty of any kind, and subject always to these Terms.

OUR INTELLECTUAL PROPERTY RIGHTS


      Certain MailBus Software may contain software that are subject to “open source” licenses (the “Open Source Software”). Where we use such Open Source Software, please note that:there may be provisions in the Open Source Software's license that expressly override these Terms, in which case such provisions shall prevail to the extent of any conflict with these Terms; andwe will credit the relevant Open Source Software used in MailBus Software within an Appendix to these terms and/or within the relevant MailBus Software.
      

OPEN SOURCE SOFTWARE

In order for us to provide MailBus to you, we may require virtual access to and/or use of your relevant device (e.g. mobile phone, tablet or desktop computer) that you use to access MailBus – for example, we may need to use your device's processor and storage to complete the relevant MailBus Software installation, or we may need to access your contact list to provide certain interactive functions within MailBus. 
 We will provide further information regarding how MailBus uses and accesses your device within MailBus or in another manner (e.g. via the relevant app store as part of the installation process for MailBus on your device). You agree to give us such access to and use of your device, and you acknowledge that if you do not provide us with such right of use or access, we may not be able to provide MailBus (or certain features within MailBus) to you. 
 Any Personal Information (as defined in the MailBus Privacy Policy) that we use or access within your device will be treated in accordance with these Terms, including our MailBus Privacy Policy. 
 You may need an adequate internet connection in order to authenticate your MailBus account or use MailBus. You may also be required to activate certain functionalities within MailBus in the manner described within MailBus. You may not be able to use certain functionalities within MailBus if you do not comply with such requirements.

USE OF YOUR DEVICE BY MailBus

You are solely responsible for any software (whether your own software or software supplied by third parties) used by you in connection with your use of MailBus, including any third party software or services made available to you through MailBus ("Third Party Software"). 
 Please note that we are not responsible for and are not liable for any damages or losses arising from your use of the Third Party Software and we do not endorse, support or guarantee the quality, reliability or suitability of any Third Party Software.  Please note that we are not responsible for any third party charges you incur (including any charges from your internet and telecommunication services providers) in relation to or arising from your use of MailBus or MailBus Software.

THIRD PARTY SOFTWARE AND CONNECTIVITY

We warrant to you that we will provide MailBus using reasonable care and skill. 
 APART FROM THIS WARRANTY, TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, MailBus (INCLUDING ANY MailBus SOFTWARE) IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND NEITHER US NOR ANY OF OUR AFFILIATE COMPANIES MAKE ANY REPRESENTATION OR WARRANTY OR GIVE ANY UNDERTAKING IN RELATION TO MailBus, ANY MailBus SOFTWARE OR ANY DATA, MEDIA OR OTHER CONTENT SUBMITTED, TRANSMITTED OR DISPLAYED BY MailBus, INCLUDING: (A) ANY REPRESENTATION, WARRANTY OR UNDERTAKING THAT MailBus OR MailBus SOFTWARE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE OR FREE FROM VIRUSES; (B) THAT MailBus OR MailBus SOFTWARE WILL BE COMPATIBLE WITH YOUR DEVICE; OR (C) THAT MailBus OR MailBus SOFTWARE WILL BE OF MERCHANTABLE QUALITY, FIT FOR A PARTICULAR PURPOSE OR NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OF ANY PERSON. TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, YOU WAIVE ANY AND ALL IMPLIED REPRESENTATIONS, WARRANTIES AND UNDERTAKINGS.

WARRANTY AND DISCLAIMER

TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, THE TOTAL AGGREGATE LIABILITY OF US AND OUR AFFILIATE COMPANIES FOR ALL CLAIMS IN CONNECTION WITH THESE TERMS, OR MailBus (INCLUDING ANY MailBus SOFTWARE), ARISING OUT OF ANY CIRCUMSTANCES, WILL BE LIMITED TO THE GREATER OF THE FOLLOWING AMOUNTS: (A) THE AMOUNT THAT YOU HAVE PAID TO US FOR YOUR USE OF MailBus OR MailBus SOFTWARE TO WHICH THE CLAIM RELATES IN THE 6 MONTHS IMMEDIATELY PRECEDING THE DATE OF THE MOST RECENT CLAIM; AND (B) USD100 (ONE HUNDRED US DOLLARS). TO THE EXTENT PERMITTED BY APPLICABLE LAWS AND REGULATIONS, IN NO EVENT WILL WE OR ANY OF OUR AFFILIATE COMPANIES BE LIABLE FOR ANY OF THE FOLLOWING: 
 IN CONNECTION WITH THESE TERMS OR MailBus OR MailBus SOFTWARE, FOR ANY DAMAGES OR LOSSES CAUSED BY: (A) ANY NATURAL DISASTER SUCH AS FLOODS, EARTHQUAKES OR EPIDEMICS; (B) ANY SOCIAL EVENT SUCH AS WARS, RIOTS OR GOVERNMENT ACTIONS; (C) ANY COMPUTER VIRUS, TROJAN HORSE OR OTHER DAMAGE CAUSED BY MALWARE OR HACKERS; (D) ANY MALFUNCTION OR FAILURE OF OUR OR YOUR SOFTWARE, SYSTEM, HARDWARE OR CONNECTIVITY; (E) IMPROPER OR UNAUTHORISED USE OF MailBus OR MailBus SOFTWARE; (F) YOUR USE OF MailBus OR MailBus SOFTWARE IN BREACH OF THESE TERMS; (G) ANY REASONS BEYOND OUR REASONABLE CONTROL OR PREDICTABILITY; OR (H) FAILURE TO SAVE OR BACK UP ANY DATA OR OTHER CONTENT; 
 ANY LOSS ARISING FROM ANY CONTENT, PROGRAMS OR SERVICES PROVIDED BY ANY PARTY OTHER THAN US (OR OUR AFFILIATES); 
 ANY LOSS OR DAMAGE WHICH ARE NOT FORESEEABLE, INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OR LOSSES. FOR THE PURPOSES OF THIS CLAUSE, LOSS OR DAMAGE IS FORESEEABLE IF EITHER IT IS OBVIOUS THAT IT WILL HAPPEN OR IF, AT THE TIME THE CONTRACT WAS MADE, BOTH WE AND YOU KNEW IT MIGHT HAPPEN; AND/OR 
 ANY:
 LOSS OF USE;
 LOSS OR INTERRUPTION OF BUSINESS;
 LOSS OF REVENUES;
 LOSS OF PROFITS;
 LOSS OF GOODWILL;
 LOSS OR DESTRUCTION OF CONTENT OR DATA.
 Nothing in these Terms limits or excludes any of the following liabilities, except to the extent that such liabilities may be waived, limited or excluded under applicable laws and regulations: 
 any liability for fraud; 
 any liability for negligently caused death or personal injury; 
 any liability for gross negligence or willful misconduct; or 
 any other liability to the extent that such other liability cannot be waived, limited or excluded under applicable laws and regulations. 
 NOTWITHSTANDING ANY OTHER PROVISIONS OF THESE TERMS, NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY OF YOUR STATUTORY RIGHTS IN YOUR JURISDICTION (INCLUDING ANY RIGHTS UNDER APPLICABLE CONSUMER PROTECTION REGULATION), TO THE EXTENT SUCH STATUTORY RIGHTS MAY NOT BE EXCLUDED OR WAIVED UNDER APPLICABLE LAWS AND REGULATIONS. 
 YOU AGREE THAT YOU (AND YOUR ORGANISATION, IF YOU ARE USING MailBus OR MailBus SOFTWARE ON BEHALF OF SUCH ORGANISATION) INDEMNIFY US AND OUR AFFILIATE COMPANIES FROM AND AGAINST ANY CLAIM, SUIT, ACTION, DEMAND, DAMAGE, DEBT, LOSS, COST, EXPENSE (INCLUDING LITIGATION COSTS AND ATTORNEYS’ FEES) AND LIABILITY ARISING FROM: (A) YOUR USE OF MailBus OR MailBus SOFTWARE; OR (B) YOUR BREACH OF THESE TERMS.

LIABILITY FOR MailBus


      As set out in "Third Party Software" sections of these Terms, various third parties may provide certain content, services or software within MailBus.
      THESE TERMS GOVERN THE RELATIONSHIP BETWEEN YOU AND US (AND, WHERE RELEVANT, OUR AFFILIATE COMPANIES). YOUR DEALINGS WITH ALL THIRD PARTIES (INCLUDING THOSE FOUND THROUGH, PROMOTED THROUGH, ACCESSED VIA HYPERLINK THROUGH OR OTHERWISE THROUGH MailBus), ARE SOLELY BETWEEN YOU AND THE RELEVANT THIRD PARTY. SUBJECT TO MANDATORY APPLICABLE LAWS AND REGULATIONS, WE AND OUR AFFILIATE COMPANIES HAVE NO LIABILITY TO YOU IN RELATION TO ANY THIRD PARTIES (INCLUDING ANY CONTENT, SERVICES OR SOFTWARE PROVIDED BY SUCH THIRD PARTIES WITHIN MailBus), NOTWITHSTANDING YOUR ENGAGEMENT WITH ANY SUCH THIRD PARTIES THROUGH MailBus.
      

NO LIABILITY FOR THIRD PARTIES

These Terms will apply to your use of MailBus until your access to MailBus is terminated by either you or us. 
 You may terminate your use of MailBus, or any of the services accessible therein, at any time (including if we have told you about an upcoming change to all or part of MailBus or these Terms which you do not agree to). If the terminated service is a paid service, we may deduct from any refund a reasonable proportion of such fee as compensation for the costs incurred by us in ending the relevant service. 
 We may suspend or terminate your access to your account or any or all of MailBus: 
 if we undertake maintenance or support of MailBus; 
 to make changes to MailBus as notified by us to you; 
 if we reasonably believe that you have breached these Terms; 
 if your use of MailBus creates risk for us or for other users of MailBus, gives rise to a threat of potential third party claims against us or is potentially damaging to our reputation; 
 if you fail to use MailBus for a prolonged period; 
 if such suspension or termination is required due to Applicable Laws; or 
 to the extent permitted by applicable laws and regulations, for any other reason in our sole and absolute discretion, 
 and where reasonably practicable, we will give you advance notice of any suspension or termination. 
 If we suspend your access to any or all of MailBus then, to the extent permitted by applicable laws and regulations in your jurisdiction: (a) you remain responsible for all fees accrued through the date of suspension (including where the fees were incurred before suspension date but performance of the relevant obligations were after the suspension date); and (b) you remain responsible for any applicable fees for any part of MailBus to which you continue to have access. 
 If your access to MailBus is terminated (in whole or in part) by you or us, you agree that: (a) all of your rights under these Terms will terminate; (b) you remain responsible for all fees accrued through the date of termination (including where the fees were incurred before termination date but performance of the relevant obligations were after the termination date); and (c) you will immediately permanently delete all copies of MailBus Software to which the termination relates and you will immediately cease accessing and using any such MailBus Software.

TERMINATION


      Following termination of these Terms, we will only retain and use Your Content in accordance with these Terms and, to the extent Your Content includes Personal Information, the MailBus Privacy Policy. Subject to the MailBus Privacy Policy and applicable laws and regulations in your jurisdiction, where we suspend or terminate all or part of MailBus, or where your access to MailBus is terminated by you or us, we do not guarantee that we will be able to return any of Your Content back to you and we may permanently delete Your Content without notice to you at any time after termination. Please ensure that you regularly back up Your Content.
      

Retention and back-up of Your Content

Subject to the applicable laws and regulations in your jurisdiction, these Terms sets out the entire agreement between you and us in relation to MailBus – you agree that you will have no claim against us for any statement which is not explicitly set out in these Terms. The words "include" and "including" are to be construed without limitation. The invalidity of any provision of these Terms (or parts of any provision) will not affect the validity or enforceability of any other provision (or the remaining parts of that provision). If a court holds that we cannot enforce any part of these Terms as drafted, we may replace those terms with similar terms to the extent enforceable under applicable laws and regulations, without changing the remaining terms of these Terms. No delay in enforcing any provision of these Terms will be construed to be a waiver of any rights under that provision. Any rights and obligations under these Terms which by their nature should survive, including any obligations in relation to the liability of, or indemnities (if any) given by, the respective parties, will remain in effect after termination or expiration of these Terms. 
 No person other than you and us will have any right to enforce these Terms, whether pursuant to the Contracts (Rights of Third Parties) Ordinance or otherwise, and you may not delegate, assign or transfer these Terms or any rights or obligations under these Terms without our prior consent. We may freely assign or transfer these Terms or our rights and obligations under these Terms, in whole or in part, without your prior consent or prior notice to you. We may freely sub-contract any part of our performance of these Terms at any time, without your prior consent or prior notice to you.

GENERAL

Except to the extent that: (a) any applicable additional terms incorporated into these Terms provide differently, or (b) the applicable laws and regulations of your jurisdiction mandate otherwise (for example, you may have statutory rights in your jurisdiction in relation to bringing or defending claims in a local court (including small claims court)): 
 these Terms and any dispute or claim arising out of or in connection with these Terms will be governed by the law of Singapore; and any dispute, controversy or claim (whether in contract, tort or otherwise) arising out of, relating to, or in connection with these Terms, including their existence, validity, interpretation, performance, breach or termination, will be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre. There will be one arbitrator only. The arbitration proceedings will be conducted in Singapore.

GOVERNING LAW AND DISPUTE RESOLUTION

 为使用本软件，您(以下简称“用户”)应当阅读并遵守本软件许可及服务协议》(以下简称“本协议”)。用户应认真阅读、充分理解本协议中各条款，包括免除或者限制本公司的责任的免责条款，以及对用户的权利限制条款。请审慎阅读后，选择接受或不接受本协议(未成年人应在法定监护人陪同下阅读)。除非用户接受本协议所有条款，否则用户无权下载、安装或使用本软件及其相关服务。用户的下载、安装、使用、帐号获取和登录等行为将被视为对本协议的接受，并表示用户同意受本协议各项条款的约束。 
 本协议可由本公司随时更新，更新后的协议条款一旦公布即代替原来的协议条款，恕不另行通知。用户可重新下载安装本软件或移步本公司网站查阅最新版协议条款。在本公司修改协议条款后，若用户不接受修改后的条款，请立即停止使用本公司提供的软件和服务，用户继续使用本公司提供的软件和服务将被视为已接受了修改后的协议。

1. 本协议是用户与本公司之间关于用户下载、安装、使用、复制本软件所订立的协议。 
 2. 本软件的所有权和运营权，以及业务规则及活动的解释权均归本公司所有。 
 3. 若有违反本条款之规定，本公司有权不经通知终止相关服务。

一、协议的范围

1. 本软件的一切著作权、商标权、专利权、商业秘密等知识产权，以及与本软件相关的所有信息内容(包括但不限于文字、图片、音频、视频、图表、界面设计、版面框架、有关数 据或电子文档等)均受中华人民共和国法律法规和相应的国际条约保护，除涉及第三方授权的软件或技术外，本公司享有上述知识产权。 
 2. 未经本公司或相关权利人书面同意，用户不得为任何商业或非商业目的自行或许可任何第三方实施、利用、转让上述知识产权。

二、知识产权声明

1. 用户可以为非商业目的在最多五台设备(包括iOS设备和Android设备)上安装、使用、 显示、运行本软件。用户不得为商业运营目的安装、使用、运行本软件，不可以对本软件或者本软件运行过程中释放到任何设备内存中的数据及本软件运行过程中客户端与服务器端的交互数据进行复制、更改、修改，形式包括但不限于使用插件、外挂或非经授权的第三方工具/服务接入本软件和相关系统。 
 2. 未经本公司书面同意，用户不得对本软件进行反向工程、反向编译或反汇编，本公司保留追究上述未经许可行为的权利。 
 3. 本条及本协议其他条款未明示授权的其他一切权利仍由本公司保留，用户在行使这些权利时须另外取得本公司的书面许可。本公司如果未行使前述任何权利，并不构成对该权利的放弃。

三、使用许可

1. 用户可以直接从本公司的网站上获取本软件，也可以从得到本公司授权的第三方获取。 
 2. 如果用户从未经本公司授权的第三方获取本软件或与本软件名称相同的安装程序，本公司无法保证该软件能够正常使用，并对因此给用户造成的损失不予负责。

四、软件的获取

1. 为了改善用户体验、完善服务内容，本公司将不断努力开发新的软件功能及服务，并为用户不时提供软件更新(这些更新可能会采取软件替换、修改、功能强化、版本升级等形式)。 
 2. 为了保证本软件的安全性和功能的一致性，本公司有权不经向用户特别通知而对软件进行更新，或者对软件的部分功能效果进行改变或限制。 
 3. 本软件新版本发布后，旧版本的软件可能无法使用。本公司不保证旧版本软件继续可用及相应的客户服务，请用户随时核对并下载最新版本。

五、软件的更新

1. 保护用户个人信息是本公司的一项基本原则。除法律法规规定的情形外，未经用户许可本公司不会向第三方公开、透露用户个人信息。本公司对相关信息采用专业加密存储与传输方式，保障用户个人信息的安全。 
 2. 用户在注册帐号或使用本软件的过程中，需要提供一些必要的信息，例如:为向用户提供帐号注册服务或进行用户身份识别，需要用户填写手机号码;手机通讯录匹配功能需要用户授权访问手机通讯录等。除非国家法律法规或政策有特殊规定的，用户需要提供真实的身份信息。若用户提供的信息不完整，则无法使用本软件或在使用过程中受到限制。 
 3. 本公司将运用各种安全技术和程序建立完善的管理制度来保护用户的个人信息，以免遭受未经授权的访问、使用或披露。 
 4. 对于本软件会如何收集、使用、存储和保护用户的个人信息，用户还可以阅读《隐私协议》予以进一步了解。

六、用户个人信息保护

1. 用户在使用本软件时可通过手机号码注册一个 MailBus 帐号，并可在注册成功后绑定一个或多个邮箱帐号。
 2. MailBus 帐号的所有权归本公司所有，用户完成申请注册手续后，仅获得 MailBus 帐号的使用权，且该使用权仅属于初始申请注册人。同时，初始申请注册人不得赠与、借用、租用、转让或售卖 MailBus 帐号或者以其他方式许可非初始申请注册人使用 MailBus 帐号。非初始申请注册人不得通过受赠、继承、承租、受让或者其他任何方式使用 MailBus 帐号。
 3. 用户有责任妥善保管注册帐号信息及帐号密码的安全，用户需要对注册帐号以及密码下的行为承担法律责任。用户同意在任何情况下不向他人透露帐号及密码信息。当用户怀疑他人在使用用户的帐号时，用户应立即通知本公司。
 4. 用户注册 MailBus 帐号后如果长期不登录该帐号，本公司有权回收该帐号，以免造成资源浪费，由此带来的任何损失均由用户自行承担。
 5. 用户理解并同意，为了向用户提供有效的服务，本软件会利用用户终端设备的处理器和带宽等资源。本软件使用过程中可能产生数据流量的费用，用户需自行向运营商了解相关资费信息，并自行承担相关费用。
 6. 用户理解并同意，本软件的某些功能可能会让第三方知晓用户的信息，例如:本软件的其他用户可以查询用户头像、昵称、邮箱地址等可公开的个人资料;使用手机号码注册统 帐号或手机号码与 MailBus 帐号关联的用户， MailBus 帐号可以被通讯录存有该号码的好友查询。
 7. 用户在使用本软件某一特定服务时，该服务可能会另有单独的协议、相关业务规则等(以下统称为“单独协议”)，用户在使用该项服务前请阅读并同意相关的单独协议;用户使用前述特定服务，即视为用户接受相关单独协议。
 8. 用户理解并同意，本公司将会尽其商业上的合理努力保障用户在本软件中的数据存储安全，但是，本公司并不能就此提供完全保证，包括但不限于以下情形:
 &nbsp;&nbsp;&nbsp;&nbsp;1) 本公司不对用户在本软件中相关数据的删除或储存失败负责;
 &nbsp;&nbsp;&nbsp;&nbsp;2) 本公司有权根据实际情况自行决定单个用户在本软件中数据的最长储存期限，并在服务器上为其分配数据最大存储空间等。用户可根据自己的需要自行备份本软件中的相关数据;
 &nbsp;&nbsp;&nbsp;&nbsp;3) 如果用户停止使用本软件或本软件的相关服务被终止或取消，本公司可以从服务器上永久地删除用户的数据。服务停止、终止或取消后，本公司没有义务向用户返还任何数据。 
 9. 用户在使用本软件时，须自行承担如下来自本软件不可掌控的风险内容，包括但不限于:
 &nbsp;&nbsp;&nbsp;&nbsp;1) 由于不可抗拒因素可能引起的个人信息丢失、泄漏等风险;
 &nbsp;&nbsp;&nbsp;&nbsp;2) 用户必须选择与所安装终端设备相匹配的软件版本，否则，由于软件与终端设备型号不相匹配所导致的任何问题或损害，均由用户自行承担;
 &nbsp;&nbsp;&nbsp;&nbsp;3) 用户在使用本软件访问第三方网站时，因第三方网站及相关内容所可能导致的风险，由用户自行承担;
 &nbsp;&nbsp;&nbsp;&nbsp;4) 用户发送的内容被他人转发、分享，因此等传播可能带来的风险和责任;
 &nbsp;&nbsp;&nbsp;&nbsp;5) 由于无线网络信号不稳定、网络服务故障或者软件故障等原因，所引起的服务登录失败、资料同步不完整、数据下载失败、页面打开速度慢、资料显示不完整等风险。

七、权利义务条款

1. 用户理解并同意，本公司一直致力于为用户提供文明健康、规范有序的网络环境，用户不得利用 MailBus 帐号或本软件制作、复制、发送、传播如下干扰本软件正常运营，以及侵犯其他用户或第三方合法权益的内容，包括但不限于:
 &nbsp;&nbsp;&nbsp;&nbsp;1) 发布、传送、传播、储存违反国家法律法规禁止的内容:
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;a) 违反宪法确定的基本原则的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;b) 危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;c) 损害国家荣誉和利益的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;d) 煽动民族仇恨、民族歧视，破坏民族团结的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;e) 破坏国家宗教政策，宣扬邪教和封建迷信的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;f) 散布谣言，扰乱社会秩序，破坏社会稳定的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;g) 散布淫秽、色情、赌博、暴力、恐怖或者教唆犯罪的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;h) 侮辱或者诽谤他人，侵害他人合法权益的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;i) 煽动非法集会、结社、游行、示威、聚众扰乱社会秩序;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;j) 以非法民间组织名义活动的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;k) 不符合遵守法律法规、社会主义制度、国家利益、公民合法利益、公共秩序、社会道德风尚和信息真实性等“七条底线”要求的;
 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;l) 含有法律、行政法规禁止的其他内容的。
 &nbsp;&nbsp;&nbsp;&nbsp;2) 发送、传播、储存侵害他人名誉权、肖像权、知识产权、商业秘密等合法权利的内容;
 &nbsp;&nbsp;&nbsp;&nbsp;3) 涉及他人隐私、个人信息或资料的内容;
 &nbsp;&nbsp;&nbsp;&nbsp;4) 发表、传送、传播骚扰、广告信息、过度营销信息及垃圾信息或含有任何性或性暗示的内容;
 &nbsp;&nbsp;&nbsp;&nbsp;5) 其他违反法律法规、政策及公序良俗、社会公德或干扰本软件正常运营和侵犯其他用户或第三方合法权益内容的信息。
 2. 用户充分了解并同意，用户必须为自己注册帐号下的一切行为负责，包括用户所发送的任 何内容以及由此产生的任何后果。用户应对本软件中的内容自行加以判断，并承担因使用内容而引起的所有风险，包括因对内容的正确性、完整性或实用性的依赖而产生的风险。本公司无法且不会对因前述风险而导致的任何损失或损害承担责任。
 3. 如果本公司发现或收到他人举报或投诉用户违反本协议约定的，本公司有权在可操作范围内不经通知随时对相关内容进行删除、屏蔽，并视行为情节对违规帐号处以包括但不限于警告、限制或禁止使用部分或全部功能、帐号封禁直至注销的处罚，并公告处理结果。
 4. 用户理解并同意，本公司有权依合理判断对违反有关法律法规或本协议规定的行为进行处罚，对违法违规的任何用户采取适当的法律行动，并依据法律法规保存有关信息向有关部门报告等，用户应独自承担由此而产生的一切法律责任。
 5. 用户理解并同意，因用户违反本协议或相关服务条款的规定，导致或产生第三方主张的任何索赔、要求或损失，用户应当独立承担责任;本公司因此遭受损失的，用户也应当一并赔偿。

八、用户行为规范

1. 用户理解并同意，本软件同大多数互联网软件一样，可能会受多种因素影响，包括但不限于用户原因、网络服务质量、社会环境等;也可能会受各种安全问题的侵扰，包括但不限于他人非法利用用户资料，进行现实中的骚扰;用户下载安装的其他软件或访问的其他网站中可能含有病毒、木马程序或其他恶意程序，威胁用户的终端设备信息和数据安全，继而影响本软件的正常使用等。因此，用户应加强信息安全及个人信息的保护意识，注意密码保护，以免遭受损失。
 2. 用户不得制作、发布、使用、传播用于窃取 MailBus 帐号、邮箱帐号及他人个人信息、财产的恶意程序。
 3. 维护软件安全与正常使用是本公司和用户的共同责任，本公司将按照行业标准合理审慎地采取必要技术措施保护用户的终端设备信息和数据安全，但是用户承认和同意本公司并不能就此提供完全保证。
 4. 在任何情况下，用户不应轻信借款、索要密码或其他涉及财产的网络信息。涉及财产操作的，请一定先核实对方身份，并请经常留意本公司有关防范诈骗犯罪的提示。

九、终端设备安全责任

1. 本软件可能会使用第三方软件或技术(包括本软件可能使用的开源代码等，下同)，这种使用已经获得合法授权。
 2. 本软件如果使用了第三方的软件或技术，本公司将按照相关法规或约定，对相关的协议或其他文件，可能通过本协议附件、在本软件安装包特定文件夹中打包、或通过网页等形式进行展示，它们可能会以“软件使用许可协议”、“授权协议”、“开源代码许可证”或其他形式来表达。前述通过各种形式展现的相关协议、其他文件及网页，均是本协议不可分割的组成部分，与本协议具有同等的法律效力，用户应当遵守这些要求。如果用户没有遵守这些要求，该第三方或者国家机关可能会对用户提起诉讼、罚款或采取其他制裁措施，并要求本公司给予协助，用户应当自行承担法律责任。
 3. 如因本软件使用的第三方软件或技术引发的任何纠纷，应由该第三方负责解决，本公司不承担任何责任。本公司不对第三方软件或技术提供客服支持，若用户需要获取支持，请与第三方联系。

十、第三方软件或技术

1. 本协议条款之效力和解释均适用中华人民共和国之法律。如协议条款之任何一部分与中华人民共和国法律相抵触，则该部分条款应按法律规定重新解释，部分条款之无效或重新解释不影响其它条款之法律效力。用户和本公司一致同意凡因本服务所产生的纠纷双方应协商解决，协商不成任何一方可提交本公司所在地上海市浦东新区有管辖权的法院诉讼裁决。
 2. 本协议可能存在包括中文、英文在内的多种语言的版本，如果存在中文版本与其他语言的版本相冲突的地方，以中文版本为准。
 3. 本协议条款无论因何种原因部分无效或不可执行，其余条款仍有效，对双方具有约束力。

We collect information when you set up your account within MailBus and use the services available within MailBus (such as Add Mail Account or Unified Account), such as email address, nickname, mobile number (if provided), avatar, and login credentials (i.e. OAuth tokens, if necessary). 

 We do not collect your mails, whether sent to or received from others. Your mails are stored on your own mail servers as well as your own devices running MailBus or other mail apps. 
 
 We use a variety of security technologies and procedures for the purpose of preventing loss, misuse, unauthorized access, or disclosure of Information – for example, we use encryption technology (such as SSL or AES) in nearly everywhere (wherever possible) within MailBus to protect certain sensitive Information provided by you to us. Please be aware that despite our efforts, no data security measures can guarantee 100% security at all times. We do not warrant or guarantee the security of MailBus or any information you provide to us through MailBus.

What data we collect about you?

We use your information to provide MailBus to you, allow you to communicate with other users. We use your information for account set-up, to facilitate communications, provide support, allow you to access features of MailBus, and to improve MailBus. MailBus uses contact channels provided by you, such as mobile number or email address, for verifying and protecting your account and for important administrative reasons and does not use these channels for promotional or marketing reasons. 

 MailBus enables certain information such as nickname and avatar to be shared publicly with your MailBus contacts and other users of MailBus. Please consider carefully what you post and communicate through MailBus. In some instances, you may control what access the wider public has to your Shared Information via the privacy settings in MailBus.

How do we use your info?


      We use third parties for support services, such as SMS service providers for account validation, Push services for new mail notification. We use these third-party services solely to process or store your information for the purposes described in this policy. We also share your information with related group companies or as required by law. Aside from the previously mentioned purposes, MailBus does not share your data to third-parties without your prior explicit consent. Any third party (selected by us) with whom we share user data will provide the same or equal protection of user data as stated in this policy. 
      

Who do we share your data with?


      Our servers are located in United States and Singapore. To continue improving the services we provide, we may have new servers located in other countries in future. We also have support, engineering and other teams located around the world. Your data may be accessed from such locations. Rigorous internal control measures are undertaken to strictly limit access to your data by designated team members. 
      

Where do we process your data?


      The time we retain your information for depends on the type of information – for example, log-in data is retained for up to 90 days from the date the data is collected. If you instruct us to delete your MailBus account, your information is deleted within 90 days of the latter of verification of account ownership and receiving your account deletion request.           
      

How long do we keep hold of your data?


      You may have special rights over your data and how we can use it. These include how you can access the data, erasing the data, restricting how your data can be used, objecting to its use, and getting a copy of your information.
      

How can I exercise my rights over my data?

 MailBus app及其相关服务(以下简称“本软件”)由上海网豆网络科技有限公司(以下简称“我们”)开发并运营。我们十分尊重并保护您(以下简称“用户”)的个人隐私权，因此制定本《隐私协议》(以下简称“本协议”)帮助用户了解我们会如何保存和保护用户的个人信息。请用户务必仔细阅读并透彻理解本协议，在确认充分理解并同意后使用本软件的各项功能和服务。

为了用户能正常使用本软件及本软件提供的各项功能，需要收集如下信息:
 1. 邮箱地址和相关认证信息(由用户提供)
 作为一个邮件客户端，当用户使用本软件时，本软件将代表用户通过相关技术协议与邮件服务器交互以使用其提供的各项服务，包括但不限于收取邮件、发送邮件等等服务。作为一个智能的邮件客户端，本软件会自动保存用户提供的邮箱地址和相关认证信息，如此用户便不需要在每次使用本软件时重新输入这些信息。本软件将对敏感信息(如密码或Token等)进行高强度加密后再存储以确保用户的信息不被窃取，不被滥用。当这些信息被通过网络进行传输时(比如与邮件服务器进行身份认证以便收发邮件)，本软件也会采用尽可能安全的措施如优先与服务器建立SSL连接、或者转为使用Token、或者额外使用高强度的加密等等可行的安全措施来保护用户的上述信息不被窃取，不被滥用。
 2. IP地址(自动获取)
 本软件的大多数功能都需要通过互联网来执行。当用户与邮件服务器或者与本软件的后端服务器交互时，对方能够通过网络连接知道用户的IP地址。
 3. Android ID、设备型号、系统和应用版本、系统语言、区域设置以及推送功能相关Token等等(自动获取)
 我们需要这些信息以便为用户执行新消息推送或者提供对应于相应的设备或者系统的服务。
 4. 邮件联系人(部分自动获取、部分由用户提供)
 本软件提供了消息推送功能以便通知用户有来自邮件联系人的新邮件，因此我们需要知道用户的邮件联系人信息以便判断是否推送来自某个发件人的新邮件消息，比如当用户为某个会话开启免打扰时，本软件将不推送属于该会话的新邮件消息。
 5. 用户为了使用本软件的功能而提供的其它信息(由用户提供)
 比如用户在本软件内设置的头像或者昵称等等信息。
 6. 统计信息(自动获取)
 为了能更好的改进本软件提供的功能，我们会收集极少量统计信息。这些信息仅用于为改进本软件提供相关支持。我们不会收集用户的敏感信息如邮件内容，同时也不会未经用户授权就向第三方提供这些信息。
 7. 其它信息(自动获取)
 在用户使用本软件，或用浏览器访问本软件平台网页时，本软件或网站服务器会自动接收并记录的用户的浏览器和计算机/设备上的信息，包括但不限于用户的IP地址、浏览器的类型、使用的语言、访问日期和时间、软硬件特征信息及用户需求的网页记录等数据。

一、为了用户正常使用本软件而需要收集的信息

用户的邮件是用户的邮件。本软件只会在用户授权的范围内访问用户的邮件内容。
 1. 用户的邮件内容存储在用户的邮件服务器以及/或者用户安装了本软件的设备里。
 2. 本软件的后端服务器不存储用户的邮件内容。
 3. 未经用户的授权，我们不会访问用户的邮件内容。
 4. 当用户在本软件内提供了邮箱地址和认证信息以便使用本软件提供的各项功能(包括但不限于收取、发送邮件等)时，用户授予了本软件访问用户的邮件内容的权限。
 在保证本软件的功能正常运作的前提下，本软件只会访问或使用尽可能少的邮件信息以确保用户的邮件内容不会被滥用。

二、本软件会如何访问用户的邮件内容

1. 本软件不会向任何无关第三方提供、出售、出租、分享或交易用户的个人信息，除非事先得到用户的许可，或该第三方和本软件(含本软件关联公司)单独或共同为用户提供服务，且在该服务结束后，其将被禁止访问包括其以前能够访问的所有这些资料。 
 2. 本软件亦不允许任何第三方以任何手段收集、编辑、出售或者无偿传播用户的个人信息。 任何本软件用户如从事上述活动，一经发现，本软件有权立即终止与该用户的服务协议。

三、信息使用

在如下情况下，本软件将依据用户的个人意愿或法律的规定全部或部分的披露用户的个人信息: 
 1. 经用户事先同意，向第三方披露; 
 2. 为提供用户所要求的产品和服务，而必须和第三方分享用户的个人信息; 
 3. 根据法律的有关规定，或者行政或司法机构的要求，向第三方或者行政、司法机构披露; 
 4. 如用户出现违反中国有关法律、法规或者本软件服务协议或相关规则的情况，需要向第三方披露; 
 5. 如用户是适格的知识产权投诉人并已提起投诉，应被投诉人要求，向被投诉人披露，以便双方处理可能的权利纠纷; 
 6. 其它本软件根据法律、法规或者相关政策认为合适的披露.

四、信息披露


      本软件收集的有关用户的信息和资料将保存在本软件及/或其关联公司的服务器上，这些信息和资料可能传送至用户所在国家、地区或本软件收集信息和资料所在地的境外并在境外被访问、存储和展示。
      

五、信息存储和交换

为保障 MailBus 的稳定运行或实现相关功能，我们可能会接入由第三方提供的软件开发包（SDK）以实现前述目的。为实现相关功能并向您提供服务，第三方SDK服务商可能会收集您相关的个人信息。我们会对该第三方获取有关信息的软件工具开发包（SDK）进行安全检测，并要求其按照服务目的、服务说明、隐私政策以及其他任何相关的保密及安全措施来处理个人信息，并且严格遵守相关法律法规与监管要求。为了满足新的服务需求及业务功能的变化，我们可能会调整我们接入的第三方SDK，我们会及时在本说明中向您公开说明最新情况。

六、 MailBus -涉及收集用户信息的第三方SDK说明

1、读取及修改存储卡权限：允许应用修改或删除存储卡上的照片、媒体内容和文件。 
2、访问大致位置信息（使用网络进行定位）：允许应用基于基站、 Wi-Fi 等网络源获取位置信息。 
3、使用手机麦克风权限： 允许应用录制音频。 
4、使用手机相机权限：允许应用拍摄照片和视频。 
5、读取存储卡中的内容：允许应用读取存储卡上的照片、媒体内容和文件。 
6、读取通话状态和移动网络信息：允许应用获取本机号码、通话状态以及拨打的号码。 
7、读取用户app安装列表：判断当前机器是否安装了应用市场，在有版本更新时跳转到匹配的应用市场。

七、权限收集说明

1、为确保本应用处于关闭或后台运行状态下可正常接收到推送的广播信息，本应用须使用自启动行为，将存在一定频率通过系统发送广播唤醒本应用自启动或关联启动行为，是因实现功能及服务所必要的。 
2、当您打开MailBus app内容类推送消息，在征得您的明确同意后，会跳转到MailBus app打开相关内容，在未征得您同意的情况下，则不会有关联启动。 
3、当您打开MailBus app内部下载的文件后，会关联启动第三方APP。

八、自启动和关联启动说明

1. 本软件会不时更新本协议。用户在同意本软件许可及服务协议之时，即视为用户已经同意本协议全部内容。如果用户不同意本协议中的任何内容，请立即停止使用本软件。 
 2. 本公司保留随时修改本协议的权利，因此请经常查看。如对本协议作出重大更改，本公司会通过网站通知的形式告知。

MailBus 作为更方便快捷的会话式邮件app的同时也保留了传统的邮件查看形式，您有以下几种方式查看传统形式的邮件：

 2. 点击会话首页左上角，展开左侧导航栏，您可点击左侧导航上您帐户下绑定的不同邮箱，进入相应的邮件列表查看邮件

          将某会话中的某发件地址设置为静音，该发件地址发送给帐号下绑定的其他会话（邮箱）的邮件在没有设置静音的情况下会正常推送邮件及通知

          群聊内发送消息的发件地址不是您的联系人时，不推送通知

 2. 当您在创建一封邮件时，在搜索联系人框内输入完整的邮件地址，系统将会对您输入的地址进行搜索，若检测出联系人列表内尚未添加该邮件地址，系统会将自动将其创建为联系人， 您可直接选择并发送邮件，发送邮件后该邮件地址会被加入到联系人，未发送则不会
 3. 当某未添加为联系人的邮件地址来信，该陌生邮件地址将会被折叠进【陌生人合集】，您可执行以下操作将其添加为联系人：
 &nbsp; &nbsp;a. 您可直接在陌生人合集列表将该邮件左滑，点击出现的【加为联系人】按钮添加为联系人，添加后该邮箱地址的来件将会正常显示在首页会话列表内

Q16.怎么添加联系人?

为了提升帐户安全性，有些邮件服务商规定在其他邮件客户端添加其帐号时，如果是POP3/SMTP/IMAP协议，必须使用「客户端授权密码」才能登陆
 若您在确认帐号及密码无误后仍然提示服务器错误，可以尝试以下几种方式：
 1. QQ、163等邮箱需要使用授权码登录，请检查是否误将密码输入到授权码输入框内，相应的授权码获取教程在输入授权码页面的右上角【获取授权码教程】可查看
 2. 在均确认输入正确的情况下仍然提示登录服务器错误，您可点击输入密码页面【下一步】按钮下的【手动配置服务器】按钮进行手动配置

Q17.添加邮箱输入帐号密码正确却提示登录服务器错误无法添加?

一般情况下，邮箱的反垃圾引擎会帮您过滤掉大部分的垃圾邮件， MailBus 会将未添加为联系人的陌生邮件地址折叠进【陌生人合集】，避免垃圾邮件占据首页会话列表带来的不便
 您也可以进入垃圾邮件的详情页面，点击右上角举报屏蔽按钮<img class="middle margin" width="30" src="https://staticprod.chirpmailapp.com/images/pc/FAQ-warning.png">对该邮件地址进行举报或举报并屏蔽
 我们将对您的反馈作出相应处理：

Q18.垃圾邮件怎么屏蔽/举报?

您只需在 MailBus 中发送邮件给该邮件地址，该邮件地址将会从黑名单中被拉出，重新变为联系人
 注：拉入黑名单后您将不会收到该邮件地址给您的来信，拉出黑名单后即可正常收发邮件

Q19.屏蔽后拉入黑名单的邮件地址怎么重新拉出来?

发件人在不同的客户端登录一个邮件地址时，对这个邮件地址设置的名称是不同的，所以您在收到同一个邮件地址的邮件时，会显示不同的名字
 您可在 MailBus 【联系人】列表内对该联系人进行备注，备注后该联系人即使在其他客户端修改了名称，只要邮件地址没变，在 MailBus 中该邮箱的名称也不会变，可有效避免因发件人修改了邮箱名称而造成的不便

Q20.为什么发件人的邮箱名称会变?

当发送邮件时，邮件可以包含发信人的名称，有如下方法可以设置该名称：
 1. 通过邮件服务器设置：比如Exchange服务器通常会把你发送的邮件的发信人名称自动替换成你在公司登记的名字，而像腾讯的企业邮箱则可以在网页版登录后，在“设置”-“帐户”-“帐号管理”-“设置”-“该帐户使用自己的昵称和签名”，输入昵称来设置你的发信人名称
 2. 在 MailBus app里设置：点击首页右下角的我的<img class="middle margin" width="25" src="https://staticprod.chirpmailapp.com/images/pc/FAQ-mine.png">，设置 MailBus 帐号，然后为 MailBus 帐号设置名字，这样通过 MailBus 发送出去的邮件会自动包含你设置的名字
 如果未作如上设置，有可能对方收到的邮件只会显示你的邮件地址，所以我们建议你在 MailBus app里设置你想要的发信人名称，设置和修改都很方便

Q21.如何设置发信人名称?

当您确定对方已发送邮件，却仍未收到邮件时，您可以参考以下方式尝试解决：
 1. 由于未添加为联系人的邮箱地址会被折叠进“陌生人合集”，您在不确定该发件邮箱地址是否已添加为联系人时，可先查看“陌生人合集”是否有该邮件
 &nbsp;&nbsp;若该邮件处于“陌生人合集”内，有如下方法可以将其移出陌生人合集：
 &nbsp;&nbsp;&nbsp;&nbsp;a. 您可直接在陌生人合集列表将该邮件左滑，点击出现的加为联系人按钮添加为联系人，添加后该邮箱地址的来件将会正常显示在首页会话列表内

 2. 一个月前的邮件收不到或不见了，请前往邮箱对应的网页版更改设置，将【仅收取最近30天】改为【收取全部】， MailBus 将为您拉取
